State Rep. Dante Pittman has put forward a new bill to reinstate North Carolina’s earned income tax credit for residents who meet federal eligibility requirements, according to the North Carolina State House.

The legislation, listed as HB 1082 and filed on April 28 during the 2025 regular session, carries the short title: ‘Tax Relief for Working Families Act.’

Our summary, based on the official bill text, explains key parts of the bill for clarity.

The proposal restores North Carolina’s earned income tax credit by offering a state income tax credit to those eligible for the federal earned income tax credit under Section 32 of the Internal Revenue Code. The state credit would equal 20% of the federal amount and be refundable, so any excess over a taxpayer’s state income tax liability would be returned as a refund. Those who are not full-year residents must prorate the credit in line with their share of North Carolina income. If enacted, the bill would apply to tax years starting on or after Jan. 1, 2026.

Lindsey Prather, among the four bill sponsors, filed 38 bills during the 2025 regular session, more than the other sponsors.

North Carolina’s legislative process for bills involves a series of steps before any bill becomes law. Legislation begins when a lawmaker files a bill, assigning it to a committee. Each chamber must read the bill three times. If changes are made after one chamber passes it, agreement must be reached on the revised version. Once both chambers approve identical language, the bill moves to the governor, who gets 10 days (or 30 if the legislature is out of session) to sign, veto, or allow the measure to become law without a signature.

Pittman earned his BA from the University of North Carolina at Chapel Hill in 2018.

Pittman, a Democrat, was first elected to the North Carolina State House in 2025 as the representative for the 24th House district, succeeding Ken Fontenot.
